TERMS AND CONDITIONS

Welcome to HeyAuPairs (“App” or “Platform”).
This App is a social networking service for AuPairs operated by MultiKultur e.K., Helmholtzstrasse 50, 50825 Cologne, Germany (“Company,” “We,” “Our,” or “Us”).
These TERMS AND CONDITIONS (the “Terms”) govern access to and use of the App and its services (together, the “Service”) by the users (“Users”, “you”, or “your”).
The Service is offered in conjunction with our established platform,
AuPair.com located at
https://www.aupair.com, which provides matchmaking between AuPairs and host families.
By registering for or using the App, you agree to comply with these Terms. If you do not agree, do not use the Service.
1. ACCEPTANCE
1.1. By accessing, browsing, visiting, registering for, or using the App and its services, you represent that you have read, understood, and agree to be bound by these Terms and all policies referenced herein.
1.2. Continued use of the Platform after any update constitutes acceptance of the revised Terms.
2. ELIGIBILITY AND REGISTRATION
2.1. Age Requirement
2.1.1. You must be at least eighteen (18) years old to register for and use the App.
2.1.2. You must have attained the age of majority as per your jurisdiction in order to register on this App.
2.1.3. You must be competent to enter into a contract under applicable laws.
2.1.4. By using our Service, you represent and warrant that you meet the above-mentioned eligibility requirements. If you do not meet these requirements, you must not use our App.
2.2. Registration Information
2.2.1. You must provide accurate, current, and complete registration details, including your name, nationality, place of origin, and date of birth.
2.2.2. You agree to update this information promptly in case of any changes.
2.3. Account Security
2.3.1. Users are solely responsible for maintaining the confidentiality of their account information and password.
2.3.2. Users are also responsible for all activities that occur under their account.
2.3.3. The App will not be held liable for any loss resulting from unauthorized use of the account.
2.3.4. You shall notify us immediately in case of any unauthorized use or activity under your account.
2.4. Multiple Accounts Prohibited
2.4.1. Users are prohibited from maintaining more than one (1) account.
2.4.2. Each account is strictly personal and cannot be transferred or shared with third-parties.
3. USER CONDUCT AND CONTENT STANDARDS
3.1. Lawful Use
3.1.1. You agree to use our Service only for lawful purposes and in compliance with these Terms.
3.1.2. Your usage of our Service shall be in compliance with the applicable German and European Union (EU) laws.
3.2. Prohibited Content and Activities
3.2.1. You must not post or transmit content that is illegal, defamatory, obscene, threatening, harassing, or discriminatory.
3.2.2. You must not share personal contact details outside designated profile fields, impersonate others, distribute malware, or engage in fraudulent conduct.
3.3. Content Moderation
3.3.1. We reserve the right to monitor, remove, or restrict any content that violates these Terms, or is otherwise objectionable, in our sole discretion.
4. USER DATA AND PRIVACY
4.1. Data Protection
4.1.1. We are committed to protecting the privacy and personal data of all users in compliance with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and other applicable laws.
4.2. Data Collected
4.2.1. During account registration, we collect name, nationality, place of origin, and age.
4.2.2. By using our services, you consent to the collection, use, storage, and transfer of your personal information as described in our
Privacy Policy.
4.3. Data Processing
4.3.1. Your data is processed on legitimate grounds such as the performance of a contract, compliance with legal obligations, and, where applicable, based on your consent.
4.3.2. You have the right to access, rectify, delete, or restrict processing of your data.
4.3.3. We do not sell personal data to third parties, and we take appropriate security measures to protect your data from unauthorized access or disclosure.
4.3.4. International transfers of data are conducted in compliance with applicable legal standards, including the use of Standard Contractual Clauses where required.

4.4. Children’s Data
4.4.1. We do not knowingly collect information from children under thirteen (13) years of age.
4.4.2. If we become aware that we have inadvertently collected personal information from a child under thirteen (13) years of age without verified parental consent, we will take immediate steps to delete such information.
4.4.3. If you believe that we might have any information from or about a child under thirteen (13) years of age, please contact us at info@heyaupairs.com.
5. DISCLAIMER AND LIMITATION OF LIABILITY
5.1. “As-Is” Service
5.1.1. The Service is provided “as-is” and “as-available,” without warranties of any kind.
5.1.2. We make no representations or warranties regarding the reliability, accuracy, availability, functionality, or suitability of the Service for any particular purpose.
5.1.3. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
5.2. No Liability for User Interactions
5.2.1. We act solely as a provider of a social networking platform that enables users to communicate with one another.
5.2.2. We are not responsible for the actions, conduct, or communications of users on the App, and we expressly disclaim any liability arising from user-to-user interactions, disputes, or relationships.
5.2.3. We do not supervise or monitor interactions between Users, and we assume no liability for any claims, disputes, damages, or injuries that may arise from interactions between Users, whether online or offline.
5.2.4. Users are solely responsible for ensuring their safety and compliance with applicable laws.
5.3. User Release
5.3.1. You agree to release, indemnify, and hold harmless MultiKultur e.K. and its officers, employees, agents, and affiliates from any and all claims, demands, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to user conduct, user-generated content, or any interactions between users, whether online or offline.
5.4. Liability Cap
5.4.1. To the fullest extent permitted by law, our total liability for any claim relating to the Service shall not exceed the amount you have paid, if any, during the twelve (12) months preceding the claim, for the features on the App.
5.4.2. We shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages.
5.5. Exclusions under German Law
5.5.1. Nothing in this clause shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under German law or applicable EU regulations.
6. LIMITED LICENSE
6.1. We grant users a limited, non-exclusive, non-transferable, and revocable license to use the Services for personal, non-commercial purposes.
6.2. This license is conditioned upon compliance with these Terms.
6.3. Users may not copy, modify, distribute, transmit, or create derivative works from any content or service provided by us.
6.4. Users also may not engage in any activity that interferes with or disrupts the Service.
7. GENERAL OBLIGATIONS AND RESPONSIBILITIES USERS
7.1. Users’ Responsibilities
7.1.1. All Users are required to provide accurate, complete, and up-to-date information during the registration process and in their personal profiles. This includes, but is not limited to, name, contact information, and any other relevant data.
7.1.2. Users agree to promptly update their profile if there are any changes to their details to ensure that the information remains accurate.
7.1.3. Users must comply with all local, national, and international laws applicable to their use of the Service.
7.1.4. Users agree to use the App only for its intended purpose, which is to connect with other AuPairs. Any other use, including but not limited to using the platform for unrelated commercial activities, is strictly prohibited.
7.1.5. Users shall refrain from any activities that may harm, disrupt, or otherwise compromise the integrity or security of the platform, including the transmission of viruses, malware, or other harmful software.
7.1.6. Users shall not attempt to access any accounts or data for which they are not authorized, nor shall they misuse any part of the platform in a manner that circumvents normal procedures and protocols.
7.1.7. Users have an obligation to report any misconduct, illegal activities, or violations of these terms that they observe on the platform. This includes, but is not limited to, inappropriate behavior, fraudulent job postings, or violations of any employment or immigration laws.
7.2. Prohibited Activities
7.2.1. Posting illegal or offensive content, including defamatory, threatening, obscene, indecent, seditious, abusive, or otherwise unlawful material.
7.2.2. Creating false or misleading profiles or impersonating another individual for any purpose, including the submission of incorrect, incomplete, or fictitious data.
7.2.3. Using the App for fraudulent purposes, such as offering services or employment that do not exist, making fraudulent claims, or engaging in deceptive practices.
7.2.4. Transmitting any malicious software, including viruses, logic bombs, Trojan horses, worms, or any other harmful programs.
7.2.5. Sharing personal contact details such as phone numbers, email addresses, or social media links outside the designated fields intended for such information. Sharing contact details outside these fields is strictly prohibited and may result in the deletion of the User’s account.
7.3. Users’ Communication
7.3.1. Users agree to communicate in a respectful and professional manner at all times. Any behavior deemed abusive, discriminatory, threatening, or harassing in nature will not be tolerated and may result in account suspension or termination.
7.3.2. All communication, including messaging and profile interactions, must be related to the legitimate purpose of the App. Inappropriate messages or solicitations for irrelevant purposes are strictly prohibited.
8. INDEMNIFICATION
8.1. Users agree to indemnify, defend, and hold harmless the App, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorney's fees, arising out of or in connection with their use of the App, violation of these Terms, or infringement of any third-party rights, including but not limited to intellectual property rights or privacy rights.
8.2. This indemnification obligation survives any termination or expiration of the User’s account and extends to all activities undertaken through the User’s account, whether by the user or any third-party.
9. CONFIDENTIALITY
9.1. Users agree to maintain the confidentiality of any non-public information they obtain through the App, including but not limited to personal information of other Users. Any unauthorized disclosure of such information, whether intentionally or negligently, may result in account termination and legal action.
9.2. We also agree to protect Users' confidential information in accordance with its Privacy Policy and applicable data protection laws, ensuring that such information is not shared with third parties without the user's explicit consent, except as required by law.
10. THIRD-PARTY LINKS
10.1. The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
10.2. Accessing third-party links is done at your own risk, and Users are encouraged to review the terms and conditions and privacy policies of the respective third-party websites they interact with.
10.3. We do not endorse, recommend, or guarantee the accuracy, relevance, or quality of services provided by third-party websites. Any interaction with third-party websites, including transactions or sharing of personal data, is solely between the User and the third party, and we shall not be liable for any claims or damages arising from such interactions.
11. INTELLECTUAL PROPERTY (IP) RIGHTS
11.1. All content, trademarks, logos, designs, images, software, user interface, and IP available on the App are the property of MultiKultur (Company) or its licensors.
11.2. Users are granted a limited, non-transferable license to access and use the platform for personal and non-commercial purposes. No rights, title, or interest in the App’s intellectual property is transferred to the user, except for the limited rights granted under these terms.
11.3. Users may not copy, modify, distribute, reproduce, or create derivative works based on the platform’s content or any part of it, without express written permission from us.
11.4. Any unauthorized use of the App’s IP may result in legal action.
12. FORCE MAJEURE
12.1. We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, natural disasters, government restrictions, or technical failures also known as Force Majeure Events.
12.2. On the occurrence of a Force Majeure Event, we will make reasonable efforts to resume its services as soon as practicable but shall not be held responsible for any resulting damages or losses incurred by the user due to the interruption.
13. TERM AND TERMINATION
13.1. These terms will remain in effect while you use the App or hold an active account.
13.2. Users may terminate their accounts at any time by following the App’s procedures for account deactivation or by contacting our customer support.
13.3. We reserve the right to suspend, block, deactivate, or terminate a User’s account without notice for any violation of these Terms, misuse of the platform, or for any reason at its sole discretion.
13.4. Upon termination, all rights granted to the user under these terms will immediately cease.
14. DISPUTE RESOLUTION
14.1. You agree to first notify us in writing at info@heyaupairs.com. detailing the dispute and desired remedy, before initiating any formal proceeding. We will respond within fourteen (14) business days, and attempt to resolve the matter within thirty (30) days of your notice.
14.2. If the good-faith resolution is unsuccessful, either party may pursue mediation or binding arbitration in Cologne, Germany, under the rules of the German Arbitration Institute (DIS), or file a legal action. The arbitration shall be conducted in English or German, as determined by the Company. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
14.3. Any claim must be filed within one (1) year of its arising, and disputes must proceed on an individual basis. You expressly waive any right to participate in class or collective actions, or representative proceedings.
14.4. Each party shall bear its own costs and attorney's fees in connection with arbitration or litigation, except where mandatory law requires otherwise.
14.5. Nothing herein limits the right of either the Company or the Users to seek injunctive relief to protect intellectual property or prevent irreparable harm.
15. GOVERNING LAW AND JURISDICTION
15.1. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. This choice of law applies to all users worldwide, regardless of their location or country of residence, including users in the United States, Canada, or any other jurisdiction.
15.2. If arbitration is not pursued or is deemed unenforceable, any judicial proceedings shall be brought exclusively in the competent courts located in Cologne, Germany, and you consent to the personal jurisdiction of those courts.

16.1. We are committed to provide exceptional customer service and support for all users of its Services.
16.2. Users can contact our customer service team via email, phone, or through the support portal available on the website for assistance with any issues or inquiries, including technical support, billing questions, and service-related concerns.
16.3. The customer service team will make reasonable efforts to respond to and resolve all inquiries promptly and professionally within the due time required.
16.4. For common questions or quick assistance, users are encouraged to visit our FAQs page, which addresses frequent queries and provides helpful information.
17. MISCELLANEOUS
17.1. Entire Agreement
17.1.1. These Terms together with the Privacy Policy, and any other policies constitute the entire agreement between the user and the App regarding the use of the Platform and supersede any prior agreements, communications, or understandings.
17.2. Severability
17.2.1. If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
17.3. Waiver
17.3.1. No waiver by us of any breach or default by the user under these Terms shall be deemed a waiver of any subsequent breach or default.
17.3.2. Any delay or failure by us to enforce its rights under these Terms shall not constitute a waiver of such rights.
17.4. Notices
17.4.1. All notices to the Platform under these Terms must be sent via the designated customer support channels or by mail to the registered address of the App.
17.4.2. Notices from us to Users will be sent via email to the address associated with the user’s account or through other appropriate communication channels, including notifications on the platform.
18. CHANGES, AMENDMENTS AND MODIFICATIONS
18. 1. We reserve the right to amend, change, and modify these Terms at any time. It is your responsibility to regularly check this page for any updates.
18.2. Continued use of the App after any changes have been made constitutes your acceptance of the revised Terms.
